TERMS & CONDITIONS

By accepting services from McCleaf Landscaping, LLC (“Company”), Client agrees to the following:

PAYMENT TERMS

• Invoices due upon completion unless otherwise stated.
• Accounts 15+ days past due accrue 1.5% monthly interest (18% APR) plus $10/month service fee.
• Client responsible for all collection costs, including attorney and court fees.
• $25 fee for returned or NSF payments.

Check Authorization

By paying by check, Client authorizes Company to process payment as a check transaction or convert it to a one-time electronic fund transfer (EFT). Funds may be withdrawn the same day.

MATERIAL OWNERSHIP

All materials remain Company property until paid in full and may be repossessed to satisfy unpaid balances.

CHANGE ORDERS & UNFORESEEN CONDITIONS

Additional work not included in the original estimate will be billed time and materials.
Company is entitled to equitable price and/or schedule adjustments for concealed conditions, subsurface obstacles, or site conditions differing from those reasonably anticipated.

PLANT WARRANTY (1 YEAR – LIMITED)

• One-time replacement of nursery stock that dies within one (1) year if properly maintained.
• Must be installed by Company.
• Entire plant must be dead.
• Covers plant only — not labor, delivery, or service.
• Excludes: roses (except Knock Out®), perennials, annuals, dogwood, magnolia, live Christmas trees, Leyland Cypress, special sale items.
• Not covered: mechanical damage, weather extremes, insects, disease, improper watering or chemical use.
• Claims must be made within one year directly through an Account Representative (not text/voicemail).
• No monetary reimbursement.
• Soil testing may be required before approval.

SERVICE ACCEPTANCE & DAMAGE CLAIMS

• Work (except mowing/snow) deemed accepted unless reported within 7 calendar days.
• Mowing and snow concerns must be reported within 24 hours.
• Damage claims must be reported within 48 hours and inspected by Company prior to repair.
• Company reserves right to correct unsatisfactory work.

LIMITATION OF LIABILITY

Maximum remedy shall not exceed original contract price (excluding taxes).
Company is not liable for incidental, consequential, or special damages.
Client agrees to hold Company harmless for damages resulting from Client actions.

PROPERTY ACCESS

Client must provide clear access to work areas and remove obstacles.
Client responsible for marking private utilities, irrigation, invisible fence lines, septic systems, etc. not located by PA One Call.
Company not responsible for damage to unmarked items. Return visits due to access issues may incur additional charges.

FORCE MAJEURE

Company is not liable for delays due to weather, supply disruptions, labor shortages, government actions, or other events beyond reasonable control. Schedule and pricing adjustments may apply.

GOVERNING LAW

Agreement governed by Pennsylvania law. Venue shall be Adams County, PA.

INSURANCE & COMPLIANCE

Company maintains required liability and workers’ compensation insurance.
